1. Acceptance of Terms

By accessing or using the ESSAI platform at essaiapp.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

ESSAI is a personal, non-commercial educational project. The Service is provided by its individual operator (“we”, “us”, or “ESSAI”).

2. Description of the Service

ESSAI is a free, non-commercial online marketing education platform that provides:

  • A marketing knowledge assessment to evaluate your skill level.
  • Structured courses, modules, and lessons on marketing topics.
  • Quizzes to test comprehension.
  • Marketing frameworks and reference materials.
  • A blog with marketing articles and insights.

3. Account Registration

Access to the Service requires an invitation code. By creating an account, you represent that:

  • You are at least 16 years of age.
  • The information you provide is accurate, complete, and current.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

4. Acceptable Use

When using the Service, you agree not to:

  • Share, redistribute, or republish course content, assessments, or quiz materials without our written consent.
  • Use automated tools, bots, or scrapers to access or extract content from the Service.
  • Attempt to gain unauthorised access to other user accounts, the admin panel, or any part of our infrastructure.
  • Submit false, misleading, or harmful content through any forms or inputs.
  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Share your invitation code with others unless explicitly permitted.

5. Intellectual Property

All content on the Service — including courses, lessons, quizzes, assessments, frameworks, blog posts, design, and branding — is the intellectual property of the ESSAI project operator or its licensors and is protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the content for your personal, non-commercial educational purposes. This licence does not include the right to:

  • Copy, modify, or create derivative works from our content.
  • Use our content for commercial training, consulting, or resale.
  • Remove any copyright or proprietary notices.

6. User Content

When you submit content through the Service (such as access request forms or assessment answers), you retain ownership of that content but grant us a worldwide, royalty-free licence to use, store, and process it for the purpose of providing the Service.

7. Assessment and Level Designation

The ESSAI assessment provides an indicative level designation based on your answers. This assessment is for educational purposes only and does not constitute a professional certification, qualification, or guarantee of competence. Results should not be relied upon for hiring decisions, professional evaluations, or any purpose beyond personal learning.

8. Availability and Modifications

We strive to keep the Service available, but we do not guarantee uninterrupted access. We reserve the right to:

  • Modify, update, or remove content at any time.
  • Change features or access requirements with reasonable notice.
  • Suspend the Service temporarily for maintenance or updates.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. ESSAI is a personal educational project and makes no guarantees regarding the accuracy, completeness, or reliability of the content provided.

10. Limitation of Liability

To the fullest extent permitted by applicable law, the operator of ESSAI shall not be liable for:

  • Any indirect, incidental, special, or consequential damages arising from your use of the Service.
  • Any loss of data, revenue, or business opportunities.
  • Any decisions made based on content provided through the Service.

11. Termination

We may suspend or terminate your access to the Service at our discretion if you breach these Terms. Upon termination:

  • Your right to access the Service ceases immediately.
  • We may delete your account and associated data in accordance with our Privacy Policy.
  • Sections on intellectual property, limitation of liability, and governing law survive termination.

12. Governing Law

These Terms are governed by the laws of France. For consumers residing in the EU, this does not affect your rights under mandatory consumer protection laws in your country of residence.
